1. Introduction
Welcome to SilverOakCommons ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at silveroakcommons.site (the "Service") operated by SilverOakCommons.
By securing a charter or utilizing our Service, you consent to abide by these Terms. Should you not agree with any part of these terms, you are prohibited from using the Service.
2. Service Overview
SilverOakCommons offers superior yacht charter services, which include but are not limited to:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
Availabilities for all services are conditional on weather patterns and we maintain the authority to alter or cease services at our discretion.
3. Booking and Reservations
3.1 Booking Process
In order to reserve a charter, you are required to:
- Have at least 18 years of age
- Submit exact and complete details
- Make the necessary prepayment as outlined in your booking confirmation
- Adhere to these Terms & Conditions
3.2 Confirmation
A confirmation of your booking is only assured following the receipt of payment and our subsequent written acknowledgement. Service may be refused to any individual at our discretion.
3.3 Availability
Charters are dependent upon vessel availability and acceptable weather conditions. Efforts will be made to accommodate your requested dates and times where possible.
4. Payment Terms
4.1 Pricing
All listed prices are in € and include applicable taxes where not otherwise indicated. Prices are susceptible to amendment without prior notification.
4.2 Payment Schedule
- Deposit: 50% of the complete cost of the charter is due upon reservation
- Final payment: Due 48 hours prior to the charter's departure
- Any additional fees (if applicable): To be paid after the charter concludes
4.3 Payment Methods
We accept the primary credit cards, bank transfers, and certified bank drafts. All payments are processed through encrypted, secure methods.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours before departure: Full refund minus transaction fees
- Between 24-72 hours before departure: Refund of 50%
- Within 24 hours of departure: No refund is available
5.2 Weather Cancellations
In the event of weather being deemed hazardous by our captain, we will propose to:
- Reschedule your charter to another suitable date without extra cost
- Issue a complete refund if rescheduling is not practicable
5.3 Mechanical Issues
If your designated vessel experiences mechanical issues, we will strive to provide an appropriate substitute. Should a substitute not be available, you will be issued a complete refund.
6. Safety and Conduct
6.1 Safety Requirements
All passengers are required to:
- Heed all directions from the crew
- Utilize the safety equipment provided when instructed
- Disclose any medical conditions that could influence their safety
- Stay within the allocated areas on the vessel
6.2 Prohibited Items
The items not allowed on board include:
- Glass containers
- Illegal substances
- Firearms or other weapons
- Excessive liquor (beyond what's deemed reasonable consumption)
- Pets (unless previously authorized)
6.3 Conduct
Passengers ought to behave respectfully. Should a passenger's conduct create safety issues or disrupts the experience for other guests, we retain the right to cease the charter immediately without offering a refund.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the amount paid for the charter. We are not accountable for:
- Injuries sustained due to negligence on the part of the passenger
- Loss or destruction of personal belongings
- Indirect, consequential, or punitive losses
- Delays as a result of weather or other events outside our control
7.2 Insurance Coverage
Comprehensive marine insurance is in place, covering our vessels and operations. Travel and personal insurance of the passengers is their own responsibility.
7.3 Assumption of Risk
By engaging in our charter services, you acknowledge the inherent dangers of maritime activities and you accept personal responsibility for your well-being and safety.
8. Modifications and Itinerary Changes
We hold the authority to alter itineraries, paths, or schedules based on factors like weather, safety necessities, or operating requirements. We will strive to provide compatible alternatives wherever feasible.
9. Force Majeure
We shall not be held accountable for any delays, cancellations, or changes caused by situations beyond our governance including, but not restricted to:
- Extreme weather events
- Natural calamities
- Regulatory actions by authorities
- Port shutdowns
- Vessel malfunctions
10. Privacy and Data Protection
Your private data is managed in line with our Privacy Policy. By availing of our services, you grant your consent for the compilation and employment of your information as outlined in our Privacy Policy.
11. Intellectual Property
Content on our service platform, including but not limited to text, images, logos, and graphics, are secured under copyright and trademark regulations. No reproduction, dissemination, or creation of derivative works are allowed without explicit written approval from us.
12. Governing Law
The Terms are subject to the governing laws of Germany. Any disputes are to be settled in the courts situated in Hamburg, Germany.
13. Changes to Terms
We hold the right to adjust these Terms at any interval. Modifications will be communicated through our website with a revised effective date. Ongoing use of our services signals your agreement to the revised terms.
